Professional indemnity insurance considerations for doctors and dentists

The topic of compliant advertising is often associated with this type of insurance which may provide some cover to defend an insured if they breach requirements.  But each policy is different and you should get advice and further information from an insurer’s product disclosure statement to find out what is covered.

The National Boards and Ahpra have jointly revised the Guidelines for advertising a regulated health service (the advertising guidelines) and the Advertising compliance and enforcement strategy for the National Scheme (the strategy).  Advance copies of the advertising guidelines and strategy are now available here and you can see more on advertising on their website.  The revised advertising guidelines and strategy will come into effect on 14 December 2020.

If you are advertising a regulated health service, your advertising must not:

  1. be false, misleading or deceptive, or likely to be misleading or deceptive
  2. offer a gift, discount or other inducement, unless the terms and conditions of the offer are also stated
  3. use testimonials or purported testimonials about the service or business
  4. create an unreasonable expectation of beneficial treatment
  5. directly or indirectly encourage the indiscriminate or unnecessary use of regulated health services
