HCCC Complaints Against Doctors

The NSW Health Care Complaints Commission (The Commission or HCCC) was established as an independent body to deal with complaints about all health service providers in NSW.

It has an overarching consideration of protecting the health and safety of the community and deals with complaints about both individual health practitioners and health organisations.

Complaints relating to individual practitioners can be about registered practitioners (such as medical practitioners, nurses and dental practitioners) or unregistered health practitioners (such as counsellors, naturopaths, cosmetic therapists, massage therapists or other alternative health service providers).

Where the complaint is about a registered practitioner, the Commission must consult with the relevant professional council about the most appropriate outcome. If a matter progresses to investigation, the possible outcomes vary depending on whether the complaint is about a registered or unregistered practitioner or an organisation.

When a complaint is made against a Doctor with the HCCC, then their professional indemnity insurance policy may fund legal defence and other potential costs to support that Doctor. The terms and conditions of what support, and how much support ,will be provided will be covered in the policy wording or Product Disclosure Statement of each insurer and may differ from one insurer to another.
